1. Ownership Declaration

All content, methodologies, frameworks, strategies, terminology, training material, written notes, video recordings, audio recordings, slide decks, charts, illustrations, and any derivative works produced, displayed, taught, distributed, or referenced on this website, in live mentorship sessions, in recorded sessions, on YouTube, on WhatsApp channels, on Telegram, in podcasts, in private communities, or through any other medium under the names “Kumar Singh,” “Kumar Singh Global Trading Academy,” “KSGTA,” or any associated brand are the exclusive intellectual property of Kumar Singh Global Trading Academy (OPC) Private Limited and Mr. Kumar Ravishanker Singh.

This includes all proprietary frameworks taught under the NIC methodology — including NIC Pro 1-on-1 Mentorship, NIC Pro Group Mentorship, and NIC Fundamentals — and all associated mentorship, support, and educational engagements delivered under the academy's name.

2. Scope of Protected Material

The following categories are protected intellectual property:

• All trading concepts, frameworks, formulas, models, and entry/exit logic developed and taught by Kumar Singh

• All proprietary terminology, naming conventions, and labels used to describe these concepts

• All written content on this website including blogs, articles, descriptions, course outlines, and explanatory notes

• All training material in any format — text, video, audio, image, infographic, slide deck, PDF, or live demonstration

• All recordings of group sessions, one-on-one mentorship sessions, podcasts, Q&A sessions, and Sunday Google Meet calls

• All YouTube content, social media content, and content distributed across any owned or operated channel

• All teaching pillars, methodology structures, and pedagogical sequences

• All branding, logos, taglines, and visual identity assets

3. Trademark Notice

Kumar Singh Global Trading Academy (OPC) Private Limited has filed and is actively prosecuting the following trademark applications before the Trade Marks Registry, Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM), Government of India. All filings have been formally accepted and have cleared the Formalities Check stage. Each application is in Class 41, covering educational services, training, mentorship, publication of educational material, and arrangement of educational events.

The ™ symbol is applied to each mark in accordance with Indian and international trademark practice to assert and provide public notice of ownership rights at the application and prosecution stage. The ® symbol will be applied to each individual mark only upon issuance of its final registration certificate by the Trademarks Registry. Pendency does not weaken enforceability. Indian trademark law grants priority of rights from the date of application, and the marks are simultaneously protected at common law on the basis of prior use and established goodwill.

These marks identify the exclusive source of all educational programs, mentorship sessions, methodologies, training material, audio-visual content, social media content, podcasts, written publications, software references, and branding produced or distributed by Kumar Singh Global Trading Academy (OPC) Private Limited and its founder, Mr. Kumar Ravishanker Singh, professionally known as Kumar Singh.

Scope of Trademark Protection

The protection asserted under these marks extends to:

• Identical marks in any spelling, casing, spacing, hyphenation, or character substitution

• Confusingly similar marks that imitate, evoke, or trade upon the goodwill of the academy

• Translations, transliterations, and phonetic equivalents in any language or script

• Use in any commercial, educational, promotional, comparative, or competing context

• Use in domain names, subdomains, social media handles, channel names, course titles, product names, paid communities, software, scripts, plugins, indicators, and automated trading systems

• Use in metadata, schema markup, search engine optimization tags, paid search bidding, keyword advertising, and any digital marketing intended to redirect, intercept, or divert traffic from the academy

• Use that implies affiliation, partnership, endorsement, sponsorship, accreditation, franchise, or certification by the academy that does not exist
  

Prohibited Acts

Without prior written permission from Kumar Singh Global Trading Academy (OPC) Private Limited, no person anywhere in the world may:

• Use, register, or apply for any identical or confusingly similar mark in any jurisdiction

• Oppose, attempt to invalidate, or interfere with the academy's pending or registered trademarks

• Use the marks in any commercial offering, paid course, mentorship program, or competing educational product

• Use the marks in book titles, video titles, podcast titles, course titles, or chapter headings of derivative or competing material

• Use the marks in a manner that dilutes, tarnishes, blurs, or weakens their distinctive character

• Use the marks in artificial intelligence training datasets, large language model fine-tuning, or any automated content generation system without express written licence
  

Common Law Rights

Independent of the pending trademark registrations, the academy asserts common law and passing-off rights in all of the above marks based on continuous and prior use in commerce, established goodwill within the trading education sector, distinctive recognition among learners and the wider public, and substantial investment in brand development, content production, and methodology research. These common law rights are independently enforceable in India and across all common law jurisdictions worldwide, including the United Kingdom, the United States, Canada, Australia, New Zealand, Singapore, and South Africa.

Statutory Framework

These marks are protected and will be enforced under:

• The Trademarks Act, 1999, and the Trademarks Rules, 2017 (India)

• The Lanham Act, 15 U.S.C. § 1051 et seq., including Section 43(a) protection for unregistered marks (United States)

• The Trademarks Act 1994 (United Kingdom)

• The European Union Trademark Regulation 2017/1001 and Trademark Directive 2015/2436

• The Trademarks Act 1995 (Australia) and the Trademarks Act 2002 (New Zealand)

• The Madrid Protocol and Madrid Agreement administered by the World Intellectual Property Organization

• The Paris Convention for the Protection of Industrial Property

• The TRIPS Agreement administered by the World Trade Organization

• All other national and regional trademark legislation in the jurisdiction where infringement occurs or where the protected marks are accessed
  

Enforcement Remedies

The academy will pursue all remedies available under law, cumulatively and not alternatively, including:

• Civil suits for trademark infringement and passing off

• Injunctive relief restraining further use of the infringing mark

• Monetary damages, account of profits, and statutory damages where applicable

• Recovery of legal costs and attorney fees

• Criminal prosecution under Sections 103, 104, and 105 of the Trademarks Act, 1999

• Customs seizure of infringing goods, packaging, and promotional material at Indian and foreign ports

• Statutory takedowns across YouTube, Instagram, Facebook, X (Twitter), LinkedIn, TikTok, Telegram, Discord, podcast platforms, web hosts, and any other platform hosting the infringing content

• Domain name disputes through INDRP (.in domains), UDRP (gTLDs), and equivalent ccTLD dispute resolution policies

This trademark protection runs concurrently with all copyright, common law, contractual, and other statutory protections set out elsewhere in this notice. Pending registrations are public records and may be independently verified on the official Trademarks Registry portal at ipindia.gov.in by searching the application numbers listed above.

4. Prohibited Use

No person, learner, student, viewer, listener, subscriber, mentee, attendee, employee, contractor, affiliate, or third party — whether based in India or in any other country — may, without prior written permission from Kumar Singh Global Trading Academy (OPC) Private Limited:

• Reproduce, copy, transcribe, or replicate any protected material in whole or in part

• Distribute, redistribute, share, forward, upload, or transmit any protected material through any medium

• Teach, train, mentor, coach, or instruct any other person using the protected material, whether for compensation or free of charge

• Publish protected material on YouTube, Instagram, Facebook, X (Twitter), LinkedIn, Threads, TikTok, Telegram, WhatsApp, Discord, Reddit, podcast platforms, blogs, websites, or any other public or private platform

• Translate, adapt, modify, or create derivative works based on the protected material

• Use the protected material to develop competing courses, programs, mentorship offerings, paid communities, indicators, software, scripts, plugins, bots, or automated trading systems

• Use any KSGTA proprietary terminology, framework names, or branding in commercial offerings

• Sell, sublicense, lease, rent, or commercially exploit the protected material in any form

This prohibition applies for the full duration of applicable copyright protection and survives the termination of any course enrollment, mentorship engagement, or relationship with the academy.

5. Global Applicability

These protections apply globally. Kumar Singh Global Trading Academy (OPC) Private Limited asserts and reserves all rights under:

• The Copyright Act, 1957 (India)

• The Information Technology Act, 2000 (India)

• The Berne Convention for the Protection of Literary and Artistic Works (180+ signatory countries)

• The TRIPS Agreement administered by the World Trade Organization

• The Digital Millennium Copyright Act (DMCA) for content distributed in or accessed from the United States

• The Copyright, Designs and Patents Act 1988 (United Kingdom)

• The Copyright Directive (EU) 2019/790 and member-state implementing legislation

• All other applicable national, regional, and international intellectual property laws in the jurisdiction where the infringement occurs or where the protected material is accessed

Any unauthorized use anywhere in the world will be addressed under the laws of the jurisdiction in which the infringement is committed, the jurisdiction in which the infringing party resides, the jurisdiction in which the protected material was accessed, and the laws of India — at the academy’s sole discretion.

6. Consequences of Unauthorized Use

The academy will actively enforce its intellectual property rights. Unauthorized use of protected material may result in:

• Immediate termination of course enrollment, mentorship engagement, and access to all academy resources, with no refund for any fees paid

• Permanent ban from all current and future academy programs, communities, and channels

• Cease-and-desist notices to the infringing party and their hosting platforms

• Takedown notices issued to YouTube, Instagram, Facebook, LinkedIn, X (Twitter), TikTok, Telegram, Discord, podcast platforms, web hosts, and any other platform hosting the infringing content

• Statutory takedowns under the DMCA (United States), the IT Act 2000 (India), the EU Copyright Directive, and equivalent regimes in other jurisdictions

• Civil legal action for injunction restraining further use, monetary damages, account of profits, and recovery of legal costs

• Recovery of liquidated damages where contractual acceptance of these terms has been recorded

• Public disclosure of confirmed infringement to protect the academy’s brand integrity and the trust of the genuine learner community

The academy reserves the right to pursue all available remedies cumulatively and not alternatively, in any competent forum of its choosing.

7. Permitted Use

Enrolled learners may use the protected material strictly for personal study and personal trading. Personal use does not include sharing recordings with non-enrolled persons, uploading material to any platform, teaching others using the material, or any commercial application whatsoever.

Brief quotations or references for genuine review, criticism, news reporting, or academic commentary are permitted under fair-dealing provisions of applicable copyright law, provided full attribution is given to “Kumar Singh, Kumar Singh Global Trading Academy” and a link to www.kumarsingh.live is included.

8. Reporting Infringement

If you discover unauthorized use of protected material anywhere online or offline, please report it to ksingh@kumarsingh.live with the URL, screenshots, and any identifying information. Verified reports may be eligible for acknowledgment at the academy’s discretion.

This Intellectual Property Rights notice is governed by the laws of India. Indian courts at Saran, Bihar shall have non-exclusive jurisdiction over disputes arising from this notice. The academy reserves the right to initiate proceedings in any other competent jurisdiction worldwide where infringement has occurred or where enforcement is sought.
