By accessing or using the website https://kumarsingh.live (the "Website"), enrolling in any course, mentorship program, workshop, webinar, or any other educational service offered by Kumar Singh Global Trading Academy (OPC) Private Limited (the "Company", "We", "Us", or "Our"), you (the "User", "Participant", or "Receiving Party") unconditionally agree to be legally bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any additional agreements or policies referenced herein.
If you do not agree to these Terms in full, you must immediately discontinue use of this Website and refrain from enrolling in or accessing any of our services.
These Terms constitute a legally binding agreement between you and the Company, enforceable under the laws of India and applicable international laws.

All content is protected under the Copyright Act, 1957 (India), and applicable international copyright conventions including the Berne Convention and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). Unauthorized reproduction, distribution, or use of any content is a criminal and civil offence.
Access to our Website or enrolment in any program does not grant the User any licence, ownership right, teaching right, distribution right, or any right to exploit the Company's intellectual property in any manner whatsoever, except for the limited right of personal use for self-directed learning and self-trading as expressly permitted.
The name "Kumar Singh Global Trading Academy", "KumarSingh.live", "Kumar Singh", and all associated logos, taglines, and branding are proprietary identifiers of the Company and its founder. Use of any such identifiers without prior written consent is strictly prohibited.
Upon enrolment in any program, course, or mentorship, participants agree to treat all information disclosed — including strategies, systems, setups, research, frameworks, concepts, live or recorded sessions, mentorship interactions, charts, presentations, PDFs, documents, and all related materials — as strictly confidential ("Confidential Information").
Confidential Information may only be used by the participant for their own personal learning and self-directed trading. Any other use — including teaching, mentoring, coaching, advising, or training any third party — is absolutely and irrevocably prohibited.
Participants shall never, directly or indirectly, by any means or medium:
Record, screen-record, audio-record, photograph, or capture any content from any session or platform
Copy, download, store, archive, mirror, scrape, or reproduce any content
Upload, publish, transmit, distribute, redistribute, resell, or sublicense any content
Share content via any application, website, platform, repository, marketplace, or group
Use content to teach, mentor, coach, advise, or train any person or entity
Modify, repackage, summaries, translate, or create derivative works from any content
Allow any third party to access content
Use content after program completion unless expressly authorized in writing by the Company
Use AI tools, automated systems, or any technology to extract, replicate, or reconstruct proprietary content
These confidentiality obligations apply worldwide, during and permanently after the course or program, irrespective of intent, and regardless of whether the content is marked confidential. These obligations are perpetual and irrevocable.
Participants who enroll in any program are required to execute the Company's Non-Disclosure, Confidentiality, Intellectual Property & Anti-Piracy Agreement, which forms an integral part of and supplements these Terms. In case of conflict between these Terms and the NDA, the NDA shall prevail with respect to confidentiality and intellectual property matters.
In addition to Section 6, the following activities are strictly prohibited on or in relation to our Website and services:
Using the Website or any service for any unlawful, fraudulent, or harmful purpose
Impersonating the Company, its founder, or any associated personnel
Attempting to gain unauthorized access to any part of the Website, learning management system, or related digital infrastructure
Introducing viruses, malware, or any other harmful code
Using automated tools, bots, or scrapers to access or extract content from the Website
Posting or transmitting any defamatory, offensive, or infringing content
Circumventing any technological protection measure or digital rights management system
Misrepresenting your identity, qualifications, or affiliations in relation to our services
Commercially exploiting any content obtained through our services
Reproducing our proprietary concepts or strategies under a different name or branding
Where access to our program or platforms requires creation of a user account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at ksingh@kumarsingh.live if you become aware of any unauthorized access to your account.
The Company reserves the right to suspend or terminate any user account at its sole discretion, including where a breach of these Terms is suspected or confirmed, without prior notice and without refund.
User accounts are non-transferable. Access credentials must not be shared with any third party under any circumstances.
All fees for courses, mentorship programm, workshops, and other services are as published on the Website at the time of enrolment, and are subject to applicable taxes including Goods and Services Tax (GST) as per Indian law.
Payment must be made in full prior to commencement of access to any program, unless a specific instalment arrangement has been agreed in writing by the Company.
Refund eligibility, timelines, and conditions are governed by the Company's published Refund and Cancellation Policy, which forms an integral part of these Terms and Conditions. Participants are required to read and accept that policy in full prior to enrollment.
The key provisions of the Refund and Cancellation Policy are summarized below for convenience. In the event of any conflict, the published Refund and Cancellation Policy shall prevail.
Participants may request a full refund of the program fee at any time before their first scheduled live teaching session begins, by writing to ksingh@kumarsingh.live with their enrollment details. No justification is required. Applicable payment gateway charges, bank fees, and statutory taxes already paid may be deducted from the refund amount.
Once a participant attends the first live teaching session, in any mode, in full or in part, no refund will be granted, full or partial, under any circumstances. Participation in the first session constitutes full commencement of service and complete consumption of the Company's proprietary intellectual property. The fee becomes non-refundable from that moment forward.
The Lifetime Mentorship Support add-on is refundable only within the cooling-off period, that is, before the first live session begins. Once the first session has been attended, the add-on becomes non-refundable, as lifetime access benefits begin accruing immediately.
If a genuine, documented emergency, such as serious illness, medical emergency, bereavement, or an Act of God beyond human control, prevents a participant from ever starting the program, a refund may be considered at the Director's sole discretion. This exception applies only to participants who have not attended any session and is granted case by case in good faith. Supporting documentation will be required.
Approved refunds are processed to the original payment method used during enrollment, typically within 7 to 14 working days from the date of approval. International refunds may take longer due to cross-border banking timelines and are processed in the original transaction currency where possible. The Company does not offer cash refunds under any circumstances.
Refunds will not be granted where the first teaching session has been attended in any mode, where the program has been fully delivered or the participant has graduated, in cases of misrepresentation of identity or intent at the time of enrollment, in cases of misuse of program materials or breach of the Company's Terms or Intellectual Property Rights, or where a refund is claimed after an unreasonable delay from the qualifying event.
The Director of Kumar Singh Global Trading Academy (OPC) Private Limited reserves the absolute and final right to approve or deny any refund request. If a refund request is declined and a participant believes the decision was unfair, the matter may be escalated through the Company's published Grievance Redressal process.
Initiating a chargeback or payment dispute without first contacting the Company constitutes a breach of these Terms. The Company reserves the right to pursue legal remedies including recovery of costs in such cases.
To the fullest extent permitted by applicable law, the Website and all services, content, and materials are provided on an "as is" and "as available" basis, without any representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or reliability.
The Company does not warrant that:
The Website will be available at all times or free from errors or interruptions
Any educational content will produce any specific trading result or financial outcome
Any strategy, framework, or concept will perform in live market conditions as it may have in historical or illustrative examples
The content will be suitable for every participant's individual circumstances, risk tolerance, or financial situation
To the maximum extent permitted by applicable law, the Company, its founder, directors, employees, agents, and associates shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with:
The use of, or inability to use, the Website or any of our services
Any trading or investment decision made by a participant, whether or not informed by our educational content
Any financial loss, loss of profit, or loss of opportunity arising from application of educational material in live markets
Errors, interruptions, or unavailability of the Website or any digital platform
Unauthorized access to or alteration of user data
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, to the extent such limitation is prohibited by applicable law.
You agree to fully indemnify, defend, and hold harmless the Company, its founder Mr. Kumar Ravishanker Singh, and all associated personnel from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
Your breach of these Terms or the NDA
Your violation of any applicable law or regulation
Your infringement of any intellectual property or other rights of the Company or any third party
Any trading or investment decision you make based on educational content accessed through our services
Any claim by a third party arising from your use or misuse of our content
Our website and programm may reference or link to third-party websites, platforms, tools, or services (including but not limited to YouTube, Telegram, WhatsApp, Google Meet, Zoom, Zerodha, TradingView, and others). Liquidated Damages: The parties acknowledge that a breach of the intellectual property, confidentiality, or anti-piracy obligations contained in these Terms and the NDA would cause irreparable harm to the Company that would be difficult to quantify. Accordingly, for each instance of breach, the breaching party agrees to pay liquidated damages of INR ₹50,00,000 (Rupees Fifty Lakhs only) per violation, which the parties agree represents a genuine pre-estimate of loss and is not a penalty. This amount is without prejudice to the Company's right to seek higher actual damages, injunctive relief, or any other remedy available under law.
In the event of any breach of these Terms or the NDA, the Company reserves the right, at its sole discretion, to pursue any or all of the following remedies:
Seek interim and permanent injunctive relief to prevent further breach
Claim damages including loss of revenue, reputation, and goodwill
Recover all legal, investigation, and enforcement costs from the breaching party
Copyright Act, 1957 — Sections 51, 63, and 65 (copyright infringement and piracy)
Information Technology Act, 2000 — Sections 43, 65, and 66 (unauthorized access and data theft)
Indian Penal Code, 1860 — Sections 406 and 420 (criminal breach of trust and fraud)
Issue DMCA and equivalent takedown notices on YouTube, Meta, Google, Telegram, and app stores
Share evidence with platform operators to seek account suspension or content removal
Initiate domain takedown proceedings where applicable
You acknowledge and consent that the Company may monitor, investigate, and collect digital evidence — including logs, screenshots, metadata, and recordings — for the purpose of enforcing its rights under these Terms and applicable law.

Any dispute, claim, or controversy arising out of or in connection with these Terms, the Privacy Policy, the NDA, or any services provided by the Company shall be subject to the exclusive jurisdiction of the courts located at the Company's place of business in Bihar, India.
For disputes involving international parties, the Company reserves the right to pursue enforcement in any jurisdiction where the breach or infringement has occurred or where the breaching party is domiciled, in accordance with applicable international law and bilateral treaties.
